  32. I am an attorney in San Francisco and I do some legal work before the Public
  33. Utilities Commission.  I noticed the information you had posted on the web
  34. about Pacific Bell application A.95-12-043 and your request that people send
  35. in protests to the PUC, and you stated that there was a deadline for these
  36. protests of 30 days after the filing date of December 5, 1995.  I just
  37. noticed your call for protests today and I started to panic to get one in
  38. because today is the 30th day.
  39.  
  40. But then I did a little research about this and I protests can actually be
  41. received by January 19 and perhaps later.  Furthermore I talked to Rob
  42. Feraru of the Public Advisor's Office and he said that this type of protest
  43. isn't even needed for this application because there will be period of time
  44. for public participation in the hearing process and there is plenty of time
  45. for anyone to register their interest in that.  He told me that he might
  46. post a message himself this evening in comp.dcom.isdn about this.

  48. My argument about the January 19'th date for protests instead of January 4th
  49. is that CPUC Rule 8.3 governs the time period for filing a protest:
  50.  
  51. "Unless otherwise provided by rule or General Order, a protest shall be
  52. filed within 30 days after the latest of the following dates:
  53.  
  54. (a) The date that copies of the application or petition, or notices thereof,
  55. were mailed to other persons, as evidenced by a certificate of service by
  56. mail;
  57.  
  58. (b) The date that notice of the filing of the application or petition first
  59. appears in the Daily Calendar...."

  63. I subscribe to the Daily Calendar and I searched through the back issues to
  64. seen when this application appeared.  It was not until the issue of December
  65. 20, therefore under (b) protests can be received until 30 days after that.
  66. There may be an even longer period under (a) because it is not clear when
  67. Pac Bell actually mailed the required notices to other utilities, etc.

  76. Its nice to see that many people feel strongly enough about this to spend
  77. some time with it!  BTW, go ahead and fax despite the language above about
  78. it "not being necessary".  Many of us will be unable to attend the hearings,
  79. and the faxes will have some weight with the CPUC.
